CASS President visits China Law Center and University of Helsinki

The President of the People’s Republic of China, Xi Jinping, visited Finland on April 4-6, 2017. During the visit, several agreements and memoranda of understanding (MoU) were signed in the fields of investment and commerce, innovation, and technology.  Among the agreements, a MoU signed between the Universities Finland (UNIFI), a co-operational organisation for Finnish universities, and the Chinese Academy of Social Sciences (CASS), an important Chinese think tank which trains researchers and is also involved in drafting laws for the People’s Republic of China, was especially significant from the Center’s perspective. The MoU aims to strengthen cooperation between CASS and Finnish Universities, enabling further bilateral agreements between Finnish universities and CASS, and its 35 institutions. The enduring cooperation between CASS and the China Law Center from its creation in 2013 has been unique, and is a significant achievement not only in Finland, but in the whole of Europe.

The China Law Center, together with the University of Helsinki, had the great pleasure to host the CASS delegation at the facilities of the UH Faculty of Law. The President of the University of Helsinki, Prof. Jukka Kola, the Dean of the Faculty of Law, Prof. Kimmo Nuotio, and the Director of the China Law Center, Prof. Ulla Liukkunen received the President of CASS, Prof. Wang Weiguang, with his delegation on April 5, 2017. The CASS delegation also included Mr. Fang Jun, Dr. Wang Lei, Prof. Chen Su, Prof. Huang Qunhui, and Ms. Shi Xuehua.

Both sides emphasized the strong history of collaboration between CASS, the UH and the China Law Center. In presenting the Center’s activities, Prof. Liukkunen introduced the numerous successful projects and publications that have resulted from the cooperation between the two institutions and their researchers, including a project that was jointly led by Prof. Liukkunen and Prof. Chen Su, Deputy Director General of the Institute of Law. The resulting publication has been a forerunner in its field. Prof. Liukkunen also introduced the volume “China and ILO Fundamental Principles and Rights at Work,” (eds Ulla Liukkunen and Chen Yifeng) which, after its publication, became a best-seller Kluwer title in the field of law. Prof. Chen Su, a long-time research partner of the China Law Center, reinforced the significance of CASS-China Law Center cooperation by noting the long history of cooperation. Prof. Su also emphasized the importance of having so many aspects included in the joint publications. He reminded that the rule of law has developed rapidly in China, and advice from international scholars has been welcomed.

In addition to acknowledging past achievements, the discussion focused on the prospects of deepening cooperation, including widening the scope to new fields, and expanding towards more international cooperation through the China Law Center. Especially Nordic cooperation was discussed, and the good potential of the Finnish China Law Center to deepen Nordic collaboration was noted. The importance of continuing existing modes of cooperation and the great prospects of further strengthening cooperation were emphasized, both with the China Law Center and the University of Helsinki.

President of Chinese Academy of Social Sciences (CASS), Prof. Wang Weiguang, visited the University of Helsinki, Faculty of Law and the Finnish China Law Center on April 5, 2017. During the discussions, all parties emphasized the success of the collaboration between CASS and the University of Helsinki and CASS and the Finnish China Law Center, and expressed their hopes that the collaboration will continue and expand.

On the previous day, April 4, the CASS delegation signed a Memorandum of Understanding with the Universities Finland (UNIFI), to strengthen cooperation between Chinese and Finnish Universities.

Prof. Wang Weiguang and the CASS representatives belong to the Chinese delegation of the President of the People’s Republic of China, Xi Jinping, who arrived in Finland the day before for a three days visit.

 

Lecture on the developments in Chinese criminal law by Prof. Dr. Renwen Liu (CASS) on February 15, 2017.

Welcome to a lecture on the developments in Chinese criminal law!

Globalization and increased inter-connectivity has posed new challenges to state governments across the world. Within the past decades, China has become increasingly emerged into the international arena, and is combating many of the same threats as western societies. Developing legislation against non-traditional threats such as terrorism has been an evolving issue, and many advancements have been made in this field in China as well.  Simultaneously, the Chinese government is dealing with domestic concerns such as corruption, as well as international criticism for its procedures in criminal conviction.

To accompany the tremendous pace of China’s economic development, Chinese criminal law has also made leaps to adapt to the increasingly internationalized context. Prof. Dr. Renwen Liu, Director of the Criminal Law Department  of the Chinese Academy of Social Sciences, will present the developments that have taken place in China’s criminal justice, such as new anti-terrorism and anti-corruption legislation. He will also present the reforms in Chinese death penalty, which have resulted in a significant drop in the number of death sentences in the past two decades.

Kimmo Nuotio, Professor of Criminal Law, and Dean of the University of Helsinki Faculty of Law, will open the event.

Guest lecture on “Policy making for sustainability in China. The role and constraints of institutionalized public participation”

img_0382The China Law Center and the University of Helsinki Department of Development Studies jointly organized a guest lecture on Policy making for sustainability in China. The role and constraints of institutionalized public participation” by Dr Daniele Bombal (Ca’ Foscari University of Venice). The lecture was held on 13 December 2016 and attracted participants from various fields of studies: law, environmental studies, development studies and chinese studies.

Abstract:

Despite retaining a restrictive political environment, in recent years the Chinese Party-State has introduced and strengthened various forms of institutionalized public participation. This trend has been particularly notable in policy areas neglected during the reforms of the 1980s and 1990s, more likely to spur dissatisfaction among the Chinese populace.

In parallel with substantial efforts towards a more sustainable path of development, the Chinese leadership has shown a growing awareness over the need to encourage public engagement. Yet, the capacity of China’s institutionalized forms of participation to influence the outcome of policy processes and to promote citizens’ empowerment remains widely debated.

This lecture aims at providing an overview over the current state of affairs in China’s public participation, by focusing on policy areas related to social and environmental sustainability. In the first part of the lecture, different forms of public participation are introduced, providing concrete examples of their utilization. In the second part, a multi-criteria tool developed by researchers at Venice Ca’ Foscari University to evaluate public participation in environmental planning is introduced, and its possible applications are discussed.

The PKU-Helsinki Law Connection grows with a successful colloquium on criminal law

The Faculty of Law at the University of Helsinki hosted the First Finnish-Chinese Colloquium on Criminal Law on 25-26 August 2016. The speakers discussed the transformation of criminal law and criminal law theory in Finland and China, sanctions and sentencing as well as criminalization and its limitations.

The event took place in a friendly atmosphere and the mutual respect enabled a genuine exchange of ideas. The insightful presentations gave a great starting point for lively and fruitful discussion that engaged not only speakers but also the audience constituted by over 20 criminal law scholars as well as legal advisers from the Finnish Ministry of Justice.

The colloquium was organized within the PKU-Helsinki Law Connection, a partnership between Peking University Law School and the Faculty of Law at the University of Helsinki. With such support from the Universities’ leaderships, the two faculties have now decided to deepen the co-operation and establish the “PKU-Helsinki Law Connection” in March 2015. Further development took place exactly a year prior the colloquium in the very same premises, when a delegation lead by Dean Professor Zhang Shouwen visited the Faculty on 24-25 August 2015.  The aim of this partnership is to consolidate and make more visible the already existing and fruitful co-operation as well as to develop new forms of collaboration for the mutual benefit. The goal is to make the existing forms of co-operation, lecture series, joint-seminars, joint publications and staff mobility, a part of the permanent structure of both institutions.

The Sino-Finnish International Seminar on Comparative Law brings together law professors from China and Finland to discuss current issues in the field of law. It is held in both countries alternately once a year.

This seminar will be held on 6 June 2016 in Helsinki and on 7 June 2016 in Tampere. This year seminar will focus on topics falling under the scope of intellectual property law, business law and taxation, as well as environmental law. The detailed program can be found on the event page.

The New Silk Road Law Schools Alliance’s research seminar was held in Helsinki

Conference Picture Road to New Paradigms

 

The International Conference on “Road to New Paradigms: Impact of China’s Silk Road Initiative in China, Central Asia and the EU” has been successfully held on 9-10 May at Helsinki. The conference was jointly organised by Faculty of Law, Aleksanteri Institute, Faculty of Social Science, of University of Helsinki, and School of Law of Xi’an Jiaotong University, in collaboration with The New Silk Road Law Schools Alliance.

Silk Road Initiative aims to bring together China, Central Asia, Russia and Europe. The five aspects of the Initiative are 1. policymaking and lawmaking; 2. infrastructure building; 3. trade; 4. currency exchange; and 5. public and social support.

So far the Initiative has mainly been focused on the economic aspect, but it is no less important to consider other aspects of the Initiative, in particular to look at what changes it might bring to political and legal arenas, and how it ties to the national identity and historical narratives of the European and Asian countries involved in the Initiative.

The aim of the conference was to go beyond the goal of economic development strongly underlined in the Initiative and focus on important but not yet discussed issues such as mobility, national identity or cultural and constitutional developments of Silk Road cooperation. The conference focused on both comparative pragmatic and theoretical aspects of these themes and aims to bring together scholars from countries participating in the Silk Road Initiative to share their perspectives on the Initiative and discuss its future impact.

Speakers from more than 10 countries across the silk road and 29 different institutions/organizations joined the conference, covering issues closely related to the “One Belt, One Road” initiative from different perspectives with different approaches.

Professor Ignazio Castellucci (University of Trento) gave a guest lecture on the “Rule of Law with Chinese Characteristics” on Wednesday, 11 May 2016.

 

The presentation revolved around the Chinese relation with the law as a tool of governance in present-day People’s Republic of China. The current Chinese concept of fă zhì (法治), which could roughly be translated as rule of law or rule by law, is a fluid one indeed, being affected by Chinese elements such as the Chinese legal history, Confucianism and elements of the Chinese-socialist concept of ‘rule of law’’. The lecture provided the students with very valuable insights on the theoretical and historical foundations of Chinese law.

The Center’s Guest Lecture Series receives scholars from China and other countries to present the recent developments in specific fields of Chinese law or their research related to Chinese law and Chinese legal culture. The purpose of this series is to keep all interested well informed about the transformations within Chinese law as well as bring awareness of the research focus among China Law scholars. Moreover, the guest lecture series aims to facilitate a cross-border exchange of ideas and promote legal comparison.

Professor Shen Wei, Dean of the Shandong University Law School, gave a guest lecture on Arbitration of International Financial Disputes in Shanghai on Monday, 2 May  2016.

The talk presented the latest developments of international commercial arbitration in China and Shanghai’s plan to turn itself to be a global financial center. The lecture gave detailed insights regarding the implementation of Shanghai’s strategy to build up dispute resolutions platforms for financial disputes. Following the interesting presentation, the audience counting mostly practitioners, including the President of the Finnish Supreme Court Timo Esko, engaged into a discussion on the challenges faced by practitioners of trans-border arbitration and the growing importance of China.

At the occasion of his visit to Finland, Professor Shen Wei has donated to the Center’s library collection his latest publication: “Investor Protection in the Capital Markets: The Case of Hong Kong. This publication focuses on and applies the investor protection benchmarks as set out in the 2014 (new) Companies Ordinance and Securities and Futures Ordinance, ranging across the following main topics: Hong Kong’s regulatory framework for the capital markets in general; Regulation of issuers through the disclosure regime; Regulation of intermediaries; Investor compensation schemes; Market misconducts regulated by the Securities and Futures Ordinance as provided for in the Securities and Futures Ordinance; Approved Trading Services (ATS); Lehman Brothers’ minibonds saga and investor protection issue in the context of structured financial products regulation; Heated debates on HKEx’s rejection of Alibaba’s request to be listed in Hong Kong.

 

The China Law Research Workshop: a platform to exchange insights on doing China Law research

China Law Research Workshop

The China Law Research Workshop, held on 21-22 March 2016 in Helsinki, offered a unique opportunity for getting information and fresh insights on how to China related legal research. The Workshop, led by Professor Alan C. Neal and Professor Ronald Brown, furthered the understanding of the research landscape in the field of law. 

The invitation to the seminar has been widely circulated and over 50 participants, coming from Finland, Sweden, Denmark, Norway, UK, Germany and Poland. have registered. Therefore, in connection to the seminar, a separate networking meeting was organized to offer a platform for exchange of ideas and insights between researchers.
