China’s International Commercial Arbitration and International Investment Arbitration – A Key Review

China is now the second largest economy with the largest amount of foreign exchange reserves in the world. China is also the second largest receiving country for foreign direct investments. Disputes in relation to foreign-invested projects are inevitable given China’s transitional stage of its economy and its weaker legal infrastructure. Therefore solving these disputes between investors as well as between foreign investors and China is crucial to the foreign investment community. This lecture will cover some key aspects of two major dispute settlement mechanisms available to foreign investors: international commercial arbitration and international investment arbitration.
Special Oriental Scholar Professor of Law, Shanghai Jiao Tong University Law School; PhD (London School of Economics and Political Science), LLM (University of Cambridge); Attorney-at-Law, New York, FHKI Arb. Professor Shen is now teaching international investment law, company law, international economic law and contact law in the law school. Professor Shen’s current research interests include international investment law, corporate governance, financial regulations, and international commercial arbitration.
